Registration and Payment Terms
The payment of your deposit to sign in a Paolo De Faveri Photography Workshop or Tour implies your full acceptance of the following Terms and Conditions.
Your registration in the workshop will be confirmed and your place will be held once the payment of the required deposit is received. However Paolo De Faveri Photography reserves the right to give it up to another guest if the payment of the full balance fee is not received 60 days prior to the beginning of the Workshop/Tour, or in any case within the date otherwise agreed upon at the moment of the registration.
Schedule Change and/ or Cancellation of a Workshop/Tour
You understand and accept that traveling with a group requires a certain level of flexibility and adaptibility and it involves compromise to accommodate the diverse desires, expectations and physical abilities of the members. You also acknowledge that while itineraries are carefully planned, they are not a guaranteed schedule of the activities and they must be intended as only a guideline and example. You therefore agree to allow for flexibility and changes deemed necessary by the Workshop/Tour's leader or professional guides. There may be situations beyond our control due to geographic,climatic, physical, or governmental restrictions that will cause further changes in timing, locations, and activities. Understanding this, you further agree that there will be no discounts or refunds for activities curtailed or otherwise affected by such circumstances.
While Paolo De Faveri Photography will put in place every attempt to run a Workshop/Tour once confirmed, we do reserve the right to change the dates or the itinerary or even cancel a Workshop/Tour, at any time due to insufficient bookings and/or for reasons that go beyond our control and might create unsafe or undesirable travel conditions for the participants.
In the event that we deem it necessary to cancel a Workshop/Tour, a full and immediate refund will be issued.
However, the financial liability of Paolo De Faveri Photography shall be limited to the monies paid to Paolo De Faveri Photographyfor the Workshop/Tour only, and shall not be extended to cover any other associated costs incurred (e.g. non-refundable air/train/ferry tickets, visa fees if applicable, equipment, miscellaneous transportation costs, medical expenses, travel insurance premiums, etc.). In consideration of this, the purchase of a travel insurance is highly recommended.
For the purposes of the Terms and Conditions described in this document, Force Majeure shall mean a cause or event that is not reasonably foreseeable or otherwise caused by or under the control of Paolo De Faveri Photography, including but not limited to: war or the threat of war, uprisings, riots, terrorism, civil strife, governmental acts, industrial disputes, labor strikes, injunctions, natural disasters, fires, unfavorable or adverse weather conditions.
You agree to release Paolo De Faveri Photography from any liabilities for delays, changes, or cancellation of a Workshop/Tour if and to the extent caused by the occurrence of a Force Majeure.
Cancellation and Refund Policy
If for any reason you have to cancel your registration and in the end the Workshop/Tour is sold out, we will refund you 100% of the monies paied minus 100 EUR as administrative fee. The refund will be issued within 30 days after the end of the Workshop/Tour.
If the Workshop/Tour is not sold out, the following policy applies:
• full refund if you cancel within 60 days from the start of the workshop.
• 50 % refund if you cancel between 60 and 30 days from the start of the workshop.
• No refund will be issued if you cancel with less than 30 days in advance.
Refunds will be paid by the same method you used to make the original payment.
All cancellation must be made in writing.
Note that there are certain Workshops/Tours where the deposits and/or any other monies paid are not refundable under any circumstances, or that have a different refund policy. In such cases, we always clearly state this in the workshop description. Always check the "Prices, Payment and Cancellation Policy" included in each page describing a workshop.
We highly recommend you purchase travel insurance for your workshop and travel expenses. Such insurance may provide coverage for losses suffered in the event of trip cancellation and interruption, travel delay, loss of baggage and travel documents, baggage delay, medical emergencies and accidental death.
Paolo De Faveri Photography is not responsible for cancellations due to medical emergencies or for reimbursement of non-refundable airline tickets in the event of a workshop cancellation.
Paolo De Faveri Photography relies upon tour operators, travel agencies, hotels, restaurants and other third party service providers to provide you with some of the services associated with the Workshops/Tour. These services are subject to the terms and conditions and other policies of the third-party service provider.
We cannot control the actions of such third-parties and you agree to hold us harmless from and against any liability for injury, death, damage, loss, accident, delay or irregularity that might occur in connection with any services provided by third parties.
Paolo De Faveri Photography do not assume responsibility for unanticipated events that may occur, including, but not limited to, travel delays, lost luggage, cancellations, overbooking, and other third party's service providers errors or neglicences.
We recommend you to allow for some flexibility in your schedule in case we need to extend the length of the Workshops/Tours or make other reasonable changes to accommodate unforseenable events such as travel delays, lost luggage, flight and/or trip cancellations, overbooking and other reservation errors. You will not be entitled to a refund in case of unanticipated events requiring scheduling changes.
In case you have reasons for complaint while attending one of our Workshops/Tours, you agree to refer it immediately to your Workshop/Tour's leader, in order to allow us to immediately take the necessary measures to solve or in any case minimise the consequences of the issue. If you fail to follow this procedure we will not have any opportunity to check and solve the issue during the Workshop/Tour, and you acknowledge that this might result in a limitation to your rights under this contract.
If a problem cannot be resolved in place, you agree to send us in written all the details, with any supporting evidence, within 10 working days from the end of our package.
In the unlikely event that a complaint cannot be settled amicably, you agree to bind yourself to submit to arbitration any claim, controversy, or dispute relating to the enforcement or interpretation of our Terms and Conditions, or arising or relating to your registration, participation, or attendance at a Workshop/Tour offered by Paolo De Faveri Photography.
You hereby agree that you will not bring an action before a judge or jury prior to submit your claim to arbitration. You also agree that the sole competent authority for such arbitration is the Arbitration Chamber of Torino, Italy.
You finally ackknowledge that any dispute will be governed by the Italian and European Union Laws and Regulations, and you agree that the Civil Court of Torino, Italy is to be acknowledged as the sole competent authority.
The participation in any outdoor activity carries with it certain inherent risks that cannot be eliminated, including, but not limited to, theft, loss or damage of personal property, bodily injury, illness, temporary or permanent disability, death, which may be caused by acts of nature, negligence or actions of others.
By registering in any Workshop, Tour or other outdoor activities offered by Paolo De Faveri Photography, you acknowledge that you are aware that such hazards, dangers, and risks, including those not mentioned herein, exist and cannot be eliminated. You also acknowledge other dangers and risks, known and unknown, may also exist. Your application shall serve as a release of our liability and a complete assumption of all risks by you, your heirs, personal representative or assigns.
You also acknowledge that you have assumed the responsibility to select an activity, among those proposed by Paolo De Faveri Photography, that is appropriate to your physical abilities and interests. You are personally responsible for being in sufficiently good health to undertake such activity. By accepting our Terms and Conditions, and by paying the deposit, you certify that you do not knowingly have any physical or other considerations of disability that would represent a risk for you or other participants.
We reserve the rights to request a doctor's statement of good health.
You acknowledge that in certain foreign, remote, wild and mountainous areas, medical services and facilities may not be readily available during all or part of the Workshop/Tour, including medical care, presence of physicians, and medication.
You understand that instructors may not possess the required training or equipment to handle incidents that may occur. In case of injury, accident, illness, or your inability to complete the Workshop/Tour, you will bear the full cost of any additional transportation or evacuation procedures performed by Paolo De Faveri Photography or others.
In consideration of, and as part of the payment for your registration in a Workshop, Tour or any other activities that Paolo De Faveri Photography or their assigns may be conducting, you for yourself, your family members and heirs, administrators, executors, successors, personal representatives or assigns, do hereby voluntarily release, waive, discharge, and covenant not to sue Paolo De Faveri Photography, Paolo De Faveri, their employees, assigns, independent contractors, or anyone involved thereof, from any damages, liabilities, costs, injuries whether mental or physical, whether known or unknown. You certify that you are voluntarily participating in these Paolo De Faveri Photography activities and assume all risks, consequences, and potential liability for this participation.
